1. Introduction These Terms and Conditions apply to use of all Costa Coffee Gift Cards. In these Terms and Conditions: "Costa" "we" or "us" refers to Costa Limited a company incorporated in England with company number 01270695 whose registered office is at Costa Limited, Costa House, 6 Porz Avenue, Houghton Hall Business Park, Houghton Regis, Dunstable, Beds, LU5 5YG . "you" refers to the purchaser and/or user of the Costa Coffee Gift Card. Purchase and/or use of a Costa Coffee Gift Card will constitute acceptance of these Terms and Conditions. Please read these Terms and Conditions carefully before using your Costa Coffee Gift Card. If there is anything you do not understand, please contact us using the contact details in paragraph 12. We recommend that you keep a copy of these Terms and Conditions for future reference. These Terms and Conditions are only available in English. Costa Coffee Gift Cards remain the property of Costa Limited.

2. Using your Costa Coffee Gift Card You may use your Costa Coffee Gift Card to purchase eligible items at any participating Costa Coffee stores in the UK excluding Northern Ireland. Costa Coffee Gift Cards are not able to be redeemed in any Costa Express or Proud to Serve outlet. When you use your Costa Coffee Gift Card the amount of your purchase will be deducted from the balance on the card. The remaining balance may be applied to future purchases. Change will not be given. If your purchase exceeds the balance on the Costa Coffee Gift Card you must pay the excess by another payment method. You may check the balance on your Costa Coffee Gift Card at any participating Costa Coffee store or on the Site. You may not top up the balance on your Costa Coffee Gift Card however you may transfer any outstanding balance to a new Costa Coffee Gift Card at any participating Costa store or by contacting Customer Services at [email protected]. Costa Coffee Gift Card balances cannot be used to purchase gift vouchers or additional gift cards. You may not exchange or redeem your Costa Coffee Gift Card for cash. No change or refunds will be given where the sales transaction is for an amount less than the balance on the Costa Coffee Gift Card. We reserve the right to refuse to accept damaged Costa Coffee Gift Cards or any Costa Coffee Gift Card which we believe has been stolen, duplicated, tampered with or is being used fraudulently or is otherwise suspected to be affected by fraud. One or more Costa Coffee Gift Cards can be redeemed against a single order but no more than five. The maximum value of Costa Coffee Gift Cards that can be uploaded at any one time is £75.

3. Expiration and Cancellation Your Costa Coffee Gift Card and the balance on it will expire if the card is not used to make a purchase for 12 consecutive months. We reserve the right to cancel your Costa Coffee Gift Card if we suspect it has been stolen, is being used fraudulently or in breach of these Terms and Conditions.

4. Loss, Theft, Damage You should take care of your Costa Coffee Gift Card and treat it like cash. Costa is not responsible for lost or stolen cards. You should immediately report any loss, theft, fraudulent or unauthorised use of your Costa Coffee Gift Card to Customer Services at [email protected] If you lose your Costa Coffee Gift Card or it is stolen or damaged we may, at our sole discretion, issue a replacement Costa Coffee Gift Card credited with the unused balance from your lost/stolen/damaged card. We will require your Costa Coffee Gift Card number and proof of purchase before we can consider any request to replace your Costa Coffee Gift Card. If you subsequently find or retrieve a Costa Coffee Gift Card which you have reported lost or stolen, you must notify Customer Services immediately.

5. Costa Coffee Club Purchases made with Costa Coffee Gift Cards in participating Costa stores will be eligible to earn Costa Coffee Club points if you are a registered Coffee Club member. Please ensure your Costa Coffee Club card is swiped or that you scan your Coffee Club mobile app in the usual way when you make your purchase. You cannot use Costa Coffee Club points to purchase Costa Coffee Gift Cards. You cannot earn Costa Coffee Card points when you purchase a Costa Coffee Gift Card. 6. Resale/Use in Promotions You may only use your Costa Coffee Gift Card for your personal non-commercial use. You may not sell your Costa Coffee Gift Card. Costa Coffee Gift Cards may not be used in sales or promotional activities including as giveaways or prizes in competitions without the prior consent of Costa. Costa reserves the right to cancel any Costa Coffee Gift Card that it suspects has been resold or obtained in connection with an unauthorised sales or promotional activity.

7. Data Protection and Privacy You may be asked to provide certain personal information, including your name, address and contact details. You agree that the information you provide to us will be true, accurate, current and complete in all respects. You also agree to notify us of any changes in this information. We are committed to maintaining the security of your personal information in accordance with the requirements of the Data Protection Act. All personal information you provide to us will be used in accordance with our Privacy policy.

8. Liability of Costa Costa shall not be liable for any loss or damage arising from or in connection with your use of a Costa Coffee Gift Card where such loss or damage arises from any cause beyond our reasonable control. If we fail to comply with these Terms and Conditions for a reason within our reasonable control, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into these Terms and Conditions. Where any loss or damage arises from a cause within our control, our liability to you shall not exceed a sum equal to the balance on your Costa Coffee Gift Card as at the date that such loss or damage occurs. This clause shall not exclude or limit any liability that cannot be excluded or limited by law.

9. Termination / Variation We reserve the right to amend or waive any provision of these Terms and Conditions from time to time or to terminate the Costa Coffee Gift Card service on reasonable notice. The Terms and Conditions applicable to the use of a Costa Coffee Gift Card shall at any time be the terms and conditions published on the Site and/or www.costa.co.uk and your continued use of a Costa Coffee Gift Card shall constitute your acceptance of such terms and conditions.

10. General These Terms and Conditions constitute the entire agreement and understanding between us and you with respect to your use of the Costa Coffee Gift Cards. If any provision of these Terms and Conditions are unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions. Any failure or delay by us in enforcing (in whole or in part) any provision of these Terms and Conditions will not be interpreted as a waiver of our rights or remedies. We may transfer the benefit of these Terms and Conditions to any other company in the same group of companies as Costa. If we assign the benefit of these Terms and Conditions, your rights will not be affected. Costa reserves the right to add to or waive these Terms and Conditions on reasonable notice for legal, security or regulatory reasons or to discontinue the Costa Coffee Gift Card scheme at any time in the event of circumstances beyond its reasonable control. Customers will be notified in advance via in-store displays in the event of any such change.

11. Governing Law These Terms and Conditions are governed by English law. These Terms and Conditions are only available in English. You agree, as we do, to submit to the non-exclusive jurisdiction of the English courts. If you live in Scotland you will also benefit from any mandatory provisions of Scottish law and can bring legal proceedings in respect of the Prize Draw and these terms and conditions in either the Scottish or the English courts.

Vue gift cards (Gift Cards) are issued by Vue Entertainment Limited, a company registered in England and Wales under company number 4699504 and whose registered office is at 10 Chiswick Road, 566 Chiswick High Road, London W4 5XS. Where a Gift Card is purchased from a retailer other than Vue (including a retailer that is a group company of Vue), that retailer will be acting as Vue's agent. 2. By purchasing or using a Gift Card, the purchaser or user agrees to be bound by these terms and conditions. 3. Currently, the balance of a Gift Card may only be redeemed at the till point of any cinema operated by Vue (or a group company of Vue) in the United Kingdom and may not, for the avoidance of doubt, be redeemed online or by telephone. This may change, at which time these terms and conditions will be updated. 4. Gift Cards should be treated as cash. Gift Cards are not cheque guarantee, credit or charge cards. 5. The Gift Card value is loaded to the Gift Card at the point of purchase. 6. The minimum amount of credit that can be loaded onto a Gift Card at any time is £5. 7. The balance of a Gift Card purchased direct from Vue only can be topped-up at any cinema operated by Vue (or a group company of Vue) in the United Kingdom. The maximum amount of credit that can be loaded onto a Gift Card at any time is £100 at a cinema operated by Vue and £200 if purchased online from Vue. 8. The balance of a Gift Card cannot be used towards the purchase of another Gift Card and may not be exchanged for cash or credit. 9. The purchase of cinema tickets and/or refreshments and/or other items shall be subject to availability. The bearer of a Gift Card shall not be entitled to any preferential rights over other cinema guests. 10. Vue's Guest Admissions Policy and Ticket Terms apply to any purchase of tickets and visit to any cinema operated by Vue (or a group company of Vue). 11. Vue accepts no liability for lost, stolen, damaged or altered Gift Cards. 12. Gift Cards may not be sold, resold or exchanged or used for any commercial purpose without Vue’s express prior written permission. 13. The balance of aGift Card can be used in full or partial transactions in conjunction with cash or another Gift Card. 14. The balance of a Gift Card is valid for 12 months from the date of the last transaction which includes the original purchase of the Gift Card, topping up the Gift Card or a purchase of tickets or items using the Gift Card. A balance enquiry does not constitute a transaction. 15. Any remaining balance of a Gift Card will be forfeited on expiry of the 12 month period as set out inparagraph14. 16. The balance of a Gift Card may not be refunded, except where you purchase the Gift Card online and exercise your right of return in accordance with paragraph 17. 17. Where you have purchased a Gift Card online directly from Vue, you have the right to request a refund from the moment you place your order until 14 days after you receive the Gift Card provided that: a. you notify Vue Guest Services that you wish to return the Gift Card by email to [email protected]; and b. provide to Vue relevant details relating to the Gift Card which include the Gift Card number, the Gift Card PIN (where applicable) and proof of purchase of the Gift Card (including method of payment) to Vue’s reasonable satisfaction. Any refunds issued pursuant to this clause 17 shall be refunded back to the original method of payment 18. Where a Gift Card is purchased online from a retailer other than Vue, please contact the appropriate retailer regarding their refund policy. 19. Vue reserves the right to change these terms and conditions at any time without notice to any bearer of a Gift Card. Changes will be posted on www.myvue.com. In the unlikely event of a failure of Vue's IT and communications systems, Vue may be unable to accept Gift Cards as payment during such system failure. 21. Vue's liability to the bearer of a Gift Card in relation to these terms and conditions shall under no circumstances exceed the balance of the Gift Card as at the date the liability arose. 22. Nothing in these terms and conditions shall exclude or limit the liability of Vue for death or personal injury arising out of its negligence or for any other liability that cannot be excluded or limited by law. 23. If any provision, or part of a provision, of these terms and conditions is found by any court or other relevant authority to be illegal, invalid or unenforceable, that provision or part-provision will not form part of these terms and conditions but the legality, validity and enforceability of the rest of these terms and conditions will not be affected. 24. These terms and conditions and any disputes or claims arising in connection with them are governed by English law. These terms and conditions are subject to the exclusive jurisdiction of the courts of England and Wales, unless you live in Scotland or Northern Ireland in which case you can bring legal proceedings in respect of the Gift Card in either the Scottish, Northern Irish or the English courts(as applicable). 25. If your enquiry relates to a particular Gift Card, please include the Gift Card number in any correspondence.

National Book Token Gift Cards are available in the UK in £s and in Ireland in €s. The Card can only be used to purchase books. It is not a credit card or a charge card, nor is it a debit card linked to a current account. It is a prepaid card which means that money must be loaded onto the Card at the time of purchase; cardholders can then use the Card to pay for full or part payments for books at participating retailers. Refunds or change will not be given. If the value of the purchase is less than the value of the card, the balance will remain on the card for future purchases. Certain limits apply to the Card. A minimum value of £1 is required to load or top-up the Card, a maximum value of £250 may be loaded onto the Card. Interest will not be payable in respect of Card balances. If the card is not used for a period of 96 consecutive months (8 years) it will expire and any remaining funds may be deducted from it. (Use for the purposes of this term includes balance enquiries) The card is for non-commercial use and may not be acquired for re-sale without written consent. Book Tokens Ltd takes a number of steps to ensure that your gift card or voucher funds are secure, so that you can spend them when are wherever you want to. This includes managing a ring-fenced investment portfolio and taking steps to ensure that the business can honour the total value of unredeemed gift cards at any one time. In addition, Book Tokens Ltd has been operating for over 80 years and its performance is not tied to the success of any one retailer. However, gift card funds are not protected under the financial services compensation scheme and the event of administration, the funds on your gift card or voucher may not be available to spend. 1. DEFINITIONS “Agreement” means the agreement between you and Book Tokens Ltd which includes these terms and conditions. “Books” means a product issued with an ISBN number “Card” means the National Book Tokens Gift Card and or eGift Card “Card Purchase” means any transaction whereby the Card is used to pay for books at Participating Retailers. “Expiry Date” means the date which is 96 months from the date of last use of the Card. “Participating Retailer” means a bookshop in the UK and Ireland which has agreed to accept the Card as payment for books, some Participating Retailers do not accept both gift card and egift card formats “Use” means a transaction as follow: initial activation of the card, any card purchase, card top-up and card balance enquiry. “We” (or “we”) and “us” means Book Tokens Ltd, 6 Bell Yard. WC2A 2JR “You” (or “you”) and “Your” (or “your”) means the person who purchased the Card or the person in possession of the Card from time to time who has been gifted the Card by the purchaser. 2. CARD 2.1 The use of the Card is subject to the terms of this Agreement as may be varied by us from time to time. The Card is transferable by delivery. We will assume, unless and until you tell us to the contrary, that the person who uses the Card at any time is the rightful user of the Card. 2.3 You may use the Card, in accordance with these terms until the card reaches its expiry date. 2.4 The Card belongs to us. It must be returned to us immediately upon request. 2.5 We may, at our discretion, block the use or operation of the Card in circumstances where; (a) there is a reasonable suspicion of fraudulent activity on the Card; or (b) there has been a breach of these terms and conditions by you. 3. PROTECTING YOUR CARD You must: (a) treat the Card as if it were cash; 1. take all reasonable care and precaution in the custody of the Card and ensure that the Card is not lost, mislaid or stolen; (c) keep your transaction receipts safe and dispose of them carefully; and 1. never give your Card number or any other Card information to anyone unless you know who they are and why they need them. 4. USING YOUR CARD 4.1 The Card may only be used in Participating Retailers. The list of Participating Retailers is available online at www.nationalbooktokens.co.uk; the list of Participating Retailers may change from time to time. 4.2 We will debit the amount of all Card Purchases to the Card. You can not use the Card to spend more than the Card balance at any time. If you attempt to spend more than the Card balance your transaction will be declined. 4.3 You cannot stop a Card Purchase after it has been authorised. 4.4 We will not issue Card statements. You can obtain your Card balance atwww.nationalbooktokens.co.uk or at Participating Retailers. You are responsible for monitoring your Card balance and for ensuring that there are sufficient funds on the Card at all times to pay for Card Purchases. 4.5 If the amount of a purchase which you wish to make using your Card is greater than the available balance, you can pay the difference in cash or by another payment method. 5. CHANGES We reserve the right at all times to introduce new Terms and Conditions and to vary or amend the existing Terms and Conditions by giving you two months notice thereof by whatever means we, in our discretion deem appropriate. 6. THEFT, LOSS OR MISUSE OF CARD You should treat the Card as if it were cash. If the Card is lost, stolen, or if the Card number becomes known to any unauthorised person you should immediately notify National Book Tokens Customer Services on +44 (0) 207 421 4640. If we can reasonably establish your rightful ownership of the Card we may be able to block the card and replace it. We will only be able to replace the value on the card at the time we establish rightful ownership and can block the card. We will charge an administration fee for this service of £3.50, this will be deducted from the card balance. 7. PARTICIPATING RETAILERS 7.1 It will be necessary in all cases, for a Participating Retailer to obtain authorisation from us to honour the Card for a particular Card Purchase; this is to ensure that there are sufficient funds on the Card. We may refuse to authorise a Card Purchase at any time if there are insufficient funds on the Card. 7.2 A Participating Retailer may not be able to obtain authorisation from us in some circumstances (for example, if there is a problem with the phone line between the Participating Retailer’s premises and our authorisation centre). If this happens Book Tokens Ltd will not be responsible if you are unable to use the Card for a particular Card Purchase. Furthermore Book Tokens Ltd will not be liable for the refusal of any Participating Retailer to accept or honour the Card for any reason. 8. DISPUTES AND COMPLAINTS 7.1 If You have any dispute about the goods You have purchased from a Participating Retailer, You should contact the Participating Retailer directly. We may use, analyse and access data to maintain and develop Our services. This may include the following purposes: to consider and implement business and product developments, to undertake statistical analysis, financial risk assessment. We will disclose information outside the Group only: where You have provided Your agreement, to Our agents or subcontractors for operational reasons, if compelled to do so by law Where You have provided Your agreement we may use your personal data for marketing purpose

National Book Token Gift Cards are available in the UK in £s and in Ireland in €s. The Card can only be used to purchase books. It is not a credit card or a charge card, nor is it a debit card linked to a current account. It is a prepaid card which means that money must be loaded onto the Card at the time of purchase; cardholders can then use the Card to pay for full or part payments for books at participating retailers. Refunds or change will not be given. If the value of the purchase is less than the value of the card, the balance will remain on the card for future purchases. Certain limits apply to the Card. A minimum value of £1 is required to load or top-up the Card, a maximum value of £250 may be loaded onto the Card. Interest will not be payable in respect of Card balances. If the card is not used for a period of 96 consecutive months (8 years) it will expire and any remaining funds may be deducted from it. In addition, Book Tokens Ltd has been operating for over 80 years and its performance is not tied to the success of any one retailer. However, gift card funds are not protected under the financial services compensation scheme and the event of administration, the funds on your gift card or voucher may not be available to spend. 1. DEFINITIONS “Agreement” means the agreement between you and Book Tokens Ltd which includes these terms and conditions. “Books” means a product issued with an ISBN number “Card” means the National Book Tokens Gift Card and or eGift Card “Card Purchase” means any transaction whereby the Card is used to pay for books at Participating Retailers. “Expiry Date” means the date which is 96 months from the date of last use of the Card. “Participating Retailer” means a bookshop in the UK and Ireland which has agreed to accept the Card as payment for books, some Participating Retailers do not accept both gift card and egift card formats “Use” means a transaction as follow: initial activation of the card, any card purchase, card top-up and card balance enquiry. “We” (or “we”) and “us” means Book Tokens Ltd, 6 Bell Yard. USING YOUR CARD 4.1 The Card may only be used in Participating Retailers. The list of Participating Retailers is available online at www.nationalbooktokens.co.uk; the list of Participating Retailers may change from time to time. 4.2 We will debit the amount of all Card Purchases to the Card. You can not use the Card to spend more than the Card balance at any time. If you attempt to spend more than the Card balance your transaction will be declined. 4.3 You cannot stop a Card Purchase after it has been authorised. 4.4 We will not issue Card statements. You can obtain your Card balance atwww.nationalbooktokens.co.uk or at Participating Retailers. You are responsible for monitoring your Card balance and for ensuring that there are sufficient funds on the Card at all times to pay for Card Purchases. 4.5 If the amount of a purchase which you wish to make using your Card is greater than the available balance, you can pay the difference in cash or by another payment method. 5. CHANGES We reserve the right at all times to introduce new Terms and Conditions and to vary or amend the existing Terms and Conditions by giving you two months notice thereof by whatever means we, in our discretion deem appropriate. 6. THEFT, LOSS OR MISUSE OF CARD You should treat the Card as if it were cash. If the Card is lost, stolen, or if the Card number becomes known to any unauthorised person you should immediately notify National Book Tokens Customer Services on +44 (0) 207 421 4640. If we can reasonably establish your rightful ownership of the Card we may be able to block the card and replace it. We will only be able to replace the value on the card at the time we establish rightful ownership and can block the card. We will charge an administration fee for this service of £3.50, this will be deducted from the card balance. 7. PARTICIPATING RETAILERS 7.1 It will be necessary in all cases, for a Participating Retailer to obtain authorisation from us to honour the Card for a particular Card Purchase; this is to ensure that there are sufficient funds on the Card. We may refuse to authorise a Card Purchase at any time if there are insufficient funds on the Card. 7.2 A Participating Retailer may not be able to obtain authorisation from us in some circumstances (for example, if there is a problem with the phone line between the Participating Retailer’s premises and our authorisation centre). If this happens Book Tokens Ltd will not be responsible if you are unable to use the Card for a particular Card Purchase. Furthermore Book Tokens Ltd will not be liable for the refusal of any Participating Retailer to accept or honour the Card for any reason. 8. DISPUTES AND COMPLAINTS 7.1 If You have any dispute about the goods You have purchased from a Participating Retailer, You should contact the Participating Retailer directly.
